How Does Workers’ Compensation Insurance Work?

Most states require businesses to carry workers’ compensation insurance. This type of insurance provides coverage to employees if they suffer a work-related injury or illness.

How Does Workers’ Compensation Insurance Work? 

Specific processes vary by state, but if a company has a workers’ compensation insurance provider, employers must submit a first report of injury form to the provider after an employee reports a work-related injury or illness. The process may involve:  

1. Employers provide information to the employee about their rights, entitlements and the assistance they may receive from workers’ compensation.  

2. Employers and the insurer may request to interview the employee to obtain details about the injury. States may also require the completion of other forms for additional information. 

3. Employers may obtain statements or interview witnesses about the situation.  

4. The employee’s doctor may submit medical documentation to the insurance provider. 

5. The insurer approves or denies the workers’ compensation claim.  

If the insurer approves the claim, the employer and employee receive information about what workers’ compensation assistance will be provided and when payments may start. If the claim is denied, the employee may request reconsideration or file an appeal with the state workers’ compensation board.  

In order to return to work, employees will likely be required to submit a medical release to their employer and the employer’s insurance provider. After returning to work and depending on the situation, other assistance may be provided. 

Additionally, it is advisable to check California’s workers’ compensation laws to get the most up-to-date information. 

What Does Workers’ Compensation Insurance Cover?  

Following a work-related injury or illness, workers’ compensation may provide: 
  • Medical benefits to help pay for medical expenses 
  •  Wage-loss benefits to help replace lost income 
  •  Vocational rehabilitation benefits to provide training or other services if the employee is unable to return to the work they were performing prior to the incident 
  •  Disability Benefits to help with benefit costs and settlements for an employee who develops a permanent disability after a work-related injury or illness 
  •  Death/dependent benefits to help pay for funeral costs and lost income if the employee passes away as a result of a work-related injury or illness. The payments may be provided to the employee’s spouse or dependents
